The war is illegal. All those who participated are guilty of "aiding and abetting an aggressive war", a capital crime.
This was the only crime used to hang all the Nazis at the end of WWII. An "aggressive war" is a first strike war. The war is illegal whether or not you want it to be, and whether or not you know it to be.
